Abstract
This essay argues that Pufendorf conceived the principles of natural law against the rationalism and innatism of the 17th century, and that Condillac similarly formulated a conception of the human origin of language, both of them thus securing open and human foundations for the two primal institutions of law and language, and also making all citizens free agents in the ordering of communal living.

Abstract
The paper, drawing on articles by J. M. E. McTaggart, G. E. Moore, D. Davidson, J. L. Austin, B. Russell, A. J. Ayer and G. E. M. Anscombe, argues that the philosophy of language in the analytic tradition has developed an “inchoative” view of time, and history is a problem as regards the existence of events in the past and how these events can be known. An alternative view is hinted at through the work of L. Wittgenstein and S. Cavell.

Abstract
There is a core conflict between conventional ideas about “meaning” and the phenomenon of meaning and meaning change in history. Conventional accounts are either atemporal or appeal to something fixed that bestows meaning, such as a rule or a convention. This produces familiar problems over change. Notions of rule and convention are metaphors for something tacit. They are unhelpful in accounting for change: there are no rule-givers or convenings in history. Meanings are in flux, and are part of a web of belief and practical activity that is in constant change. We can perhaps salvage some point to appeals to fixed frameworks if we treat them as “as if ” constructions designed as crutches to enable us to improve on literal readings of the texts by making more sense of the inferential connections and practical significance of their content at the time.

Abstract
This paper argues that not only does history matter to legal epistemology, but also that understanding legal epistemology can yield a certain understanding of the past. The paper focuses on the common law practice of precedent and argues that there is no set of rules, principles, reasons or material facts that constitute the fixed or foundational content of past decisions (a ‘timeless what’ that determines its own relevance), but rather that what is taken by a judge resolving a particular dispute to be the content of past decisions depends on the active and creative construal of relevance engaged in by that judge. Precedents are better thought of as ‘thick resources with dynamic content’. Such content is constrained by a variety of stabilising practices, but never so constrained as to determine how it can be construed to be relevant. This image of law’s past may offer a general view of the past as something with which we can actively and creatively relate in the course of coping with the present.

Four Species of Reflexivity and History of Economics in Economic Policy Science*

Abstract
This paper argues that history of economics has a fruitful, underappreciated role to play in the development of economics, especially when understood as a policy science. This goes against the grain of the last half century during which economics, which has undergone a formal revolution, has distanced itself from its ‘literary’ past and practices precisely with the aim to be a more successful policy science.
The paper motivates the thesis by identifying and distinguishing four kinds of reflexivity in economics. The main thesis of this paper is that because these forms of reflexivity are not eliminable, the history of economics must play a constitutive role in economics (and graduate education within economics). An assumption that I clarify in this paper is that the history of economics ought to be part of the subject matter studied by economics when they are interested in policy science. Even if one does not accept the conclusion, the fourfold classification of reflexivity might hold independent interest.
The paper is divided in two parts. First, by reflecting on the writings of George Stigler, Paul Samuelson, George and Milton Friedman, I offer a stylized historical introduction to and conceptualization of the themes of this paper. In particular, I identify various historically influential arguments and strategies that reduced the role of history of economics within the economics discipline. In it I also canvass six arguments that try to capture the cost to economics (understood as a science) for sidelining the history of economics from within the discipline. A sub-text of the introduction is that for contingent reasons, post World War II economics evolved into a policy science. Second, by drawing on the work of Kenneth Boulding, in particular, George Soros, Thomas Merton, Gordon Tullock, I distinguish between four species of reflexivity. These are used to then strengthen the argument for the constitutive role of the history of economics within the economics profession. In particular, I argue that so-called Kuhn-losses are especially pernicious when faced with policy choices under so-called Knightian uncertainty.

Abstract
What is it for history to matter? Stephen Gould argued that unpredictability is part of the answer. For example, the “fact” that repeated replays of the history of life would end differently every time is a sign that history matters to the course of evolution. But there is a problem here: if a particular point in the past leaves open alternative possible futures, then in what sense does that point in the past matter with regard to which of the outcomes occurs? We argue that unpredictability is central to the importance of history. However, it is not the unpredictability of the future, but rather the unpredictability of the past itself that is the key. History matters when a particular future depends on a particular past that was not bound to happen, but did.

Abstract
Naturalized metaphysics remains a default presupposition of much contemporary philosophy of physics. As metaphysics is supposed to be about the general structure of reality, so a naturalized metaphysics draws upon our best physical theories: Assuming the truth of such a theory, it attempts to answer the “foundational question par excellence”, “how could the world possibly be the way this theory says it is?” It is argued that attention to historical detail in the development and formulation of physical theories serves as an ever-relevant hygienic corrective to the “sentiment of rationality” underlying the naturalistic impulse to read ontology off of physics.

What Does History Matter to Philosophy of Science? The Concept of Replication and the Methodology of Experiments

Abstract
Scientists and philosophers generally agree that the replication of experiments is a key ingredient of good and successful scientific practice. “One-offs” are not significant; experiments must be replicable to be considered valid and important. But the term “replication” has been used in a number of ways, and it is therefore quite difficult to appraise the meaning and significance of replications. I consider how history may help – and has helped – with this task. I propose that: 1) Studies of past scientific episodes in historical context and of recent philosophical contributions to the discussion are heuristic tools for exploring and clarifying the meaning of that concept. 2) The analysis of the development of the methodological imperative of replication sheds light on the significance scientists have attached to it, thereby contributing further to the clarification of the concept. 3) The analysis of the history of philosophical thought about methods and scientific methodology helps understand why philosophers have not paid much attention to the analysis of the concept of replication.

Genealogical Pragmatism: How History Matters for Foucault and Dewey

Abstract
This article offers the outlines of a historically-informed conception of critical inquiry herein named genealogical pragmatism. This conception of critical inquiry combines the genealogical emphasis on problematization featured in Michel Foucault’s work with the pragmatist emphasis on reconstruction featured in John Dewey’s work. The two forms of critical inquiry featured by these thinkers are not opposed, as is too commonly supposed. Genealogical problematization and pragmatist reconstruction fit together for reason of their mutual emphasis on the importance of history for philosophy. In so fitting together they repair crucial deficits in both traditions as they currently stand on their own (namely, genealogy’s normative deficit and pragmatism’s excessive instrumentalism). The resulting conception of critical inquiry as simultaneously problematizational and reconstructive is offered as a first step toward a crucial philosophical task we face today: articulating normativity without foundations.

Why Does History Matter to the Science Studies Disciplines? A Case for Giving the Past Back Its Future

Abstract
Science and technology studies (STS) has perhaps provided the most ambitious set of challenges to the boundary separating history and philosophy of science since the 19th century idealists and positivists. STS is normally associated with ‘social constructivism’, which when applied to history of science highlights the malleability of the modal structure of reality. Specifically, changes to what is (e.g. by the addition or removal of ideas or things) implies changes to what has been, can be and might be. Latour’s account of Pasteur’s scientific achievement is a case in point. Two polar attitudes towards the world’s modal malleability are identified: over- and under- determination, which correspond, respectively, to a belief in the inevitability and the precariousness of science as a form of knowledge. The distinctness of these positions reflects a cordon sanitaire between the history and the philosophy of science. Consequently, historical agents are not given full voice as constructors of reality: They are either quarantined to a foreign realm called ‘the past’ by the historian or selectively assimilated to an imperial present by the philosopher. The second half of the essay explores what it might mean to restore a robust sense of reality construction to the historical agents. My case in point here is that of the 13th century Franciscan friar, Roger Bacon, who has been alternatively seen as a mad medieval or a proto-modernist. To give Bacon full voice would involve taking the future that he envisaged as a normative benchmark for judging our own world.
