Chapter Summary

One of the more established principles of environmental law is the obligation to carry out an assessment of the environmental impact of development activities at the national level. Closely linked to the concept of sustainable development, an environmental impact assessment (EIA) is an invaluable tool to achieve the principle of integration, to integrate environmental concerns into the economic development process. This chapter discusses the emergence of EIA at the international level, the influence of national law, the relevant international instruments on EIA and the content of this principle. It also discusses the procedural rights associated with the EIA process. The chapter discusses the forging links with international human rights law, as these rights derive from that branch of international law and how this principle can be improved at the international level, which has ramifications for national law.
