Chapter Summary

This chapter discusses three phases of international involvement in justice in Kosovo. First, the period from June 1999 through February 2000, during which there were international police but only Kosovar judges and prosecutors deciding the fate of the arrestees. Second, the period from the February 2000 appointment of the first two international judges and prosecutors (IJP) to mid-December 2000, when the program had grown to thirteen IJP. Third, the current phase, starting in mid-December 2000, when the criminal procedure law for Kosovo was further changed by United Nations Mission in Kosovo (UNMIK) to ensure that sensitive trials chosen by the Special Representative of the Secretary General (SRSG) would be assigned a special trial panel with a majority of international judges. The chapter discusses the need to impartially and fairly investigate, prosecute and adjudicate war crimes and Special Crimes, and to provide fairness and to eliminate impunity.
