Chapter Summary

At the end of the Kosovo armed conflict in June 1999, the United Nations Interim Administration Mission in Kosovo (UNMIK) was established with the aim of providing an interim administration to Kosovo with the mandate as described in the Security Council Resolution 1244 (1999). The SRSG first dealt with the issue of the law applicable in Kosovo in UNMIK Regulation 1999/1, Section 3, which provided that the laws applicable in the territory of Kosovo prior to 24 March 1090 shall continue to apply. However, a lack of clarity stemmed from the combined application of UNMIK regulations and applicable laws, and the application of human rights instruments' provisions. When UNMIK arrived in Kosovo in June 1999 after the armed conflict and the NATO bombing campaign, there was no functioning system of justice. A significant step was taken to deal with these concerns by the adoption of UNMIK Regulation 2000/64.
