Chapter Summary

This section presents a list of international cases relevent to international human rights litigation in U.S. courts. The courts have dismissed many cases at the outset for failure to allege a violation of international law, as they did before Sosa. The court in Arndt v. UBS AG, for example, applied pre-Sosa case law to reject Alien Tort Statute (ATS) jurisdiction over "garden variety" common law commercial claims for fraud, unjust enrichment, conversion, and misrepresentation.
