This index presents a list of terms and concepts relevant to the discussion of the environmental policy and tradeoffs of a regulatory approach versus a legal regime that derives from court-made decisions. The discussion of these issues has important implications in both Europe and the United States. The question of whether divergent standards should be permitted, or even encouraged, or whether there should be an attempt to harmonize regulatory requirements is a matter of fundamental significance in the context of the European Union Common Market project as well as in the maintenance of a unified market and federal system in the United States.
