Chapter Summary

The Vienna Convention on Succession of States in Respect of State Property, Archives and Debts of 1983 (the 1983 Convention) clarified further the modern law and policy of state succession and commercial obligations that had been codified in the Vienna Convention on Succession of States in Respect of Treaties of 1978 (the 1978 Convention). This chapter's discussion of the 1983 Convention and the 1983 Conference is grouped into three headings: (1) state property; (2) archives; and (3) debts. The law of state succession should account for the impact of successions on ownership of property when adjusting commercial obligations to harmonize self-determination with global order. The law of state succession and debt harmonized its three policies: (1) adjusting debt obligations by agreements; (2) protecting creditors and weak states; and (3) providing dispute-resolution mechanisms in different ways in relation to different categories of succession.
