Chapter Summary

Article VI General Agreement On Tariffs And Trade (GATT) regulates World Trade Organization (WTO) Members' defence against dumping and subsidization by providing them with two trade remedies: (1) anti-dumping measures (anti-dumping measures or anti-dumping duties) and (2) countervailing duties (CVDs). Article VI GATT and the Two Agreements will apply to the application of anti-dumping measures and CVDs. The definition of "like product" in an anti-dumping investigation is paramount, and it is also relevant in the dumping and injury determinations. The assessment of the extent of dumping is made by comparing the normal value of the product and its export price. Article VI:2 GATT provides the remedies that can be applied against injurious dumping. Accordingly, (1) anti-dumping duties, (2) provisional measures, and (3) price undertakings are the only permissible remedies that Members are allowed to apply within the meaning of art.
