Chapter Summary

The WTO Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994 (ADA) addresses measures that may be taken against dumping. Article VI GATT 1994 allows WTO Members when taking action against dumping to depart from two key GATT rules and one key WTO rule. Article 1 ADA lays down three principles. First, WTO Members may apply an anti-dumping measure only when the conditions set out in article VI GATT 1994 are met. Second, they may do so only pursuant to investigations in accordance with the provisions of the ADA. Third, the application of article VI GATT 1994 is governed by the ADA where a Member takes action under its anti-dumping laws.
