Chapter Summary

This chapter commences with a discussion on The International Protection of Intellectual Property and the World Trade Order. It discusses the terminology and concept of intellectual property and then talks about the international protection of intellectual property by the WIPO Conventions. The focus is on intellectual property in the World Trade Order (WTO) and the historical development of the TRIPS Agreement. As a WTO Agreement, TRIPS is part of the area of international law that one may term "the world trade order", the origins of which can be traced back to the General Agreement on Tariffs and Trade (GATT), which provisionally entered into force in 1947 as a fragmentary part of a much more comprehensive regulatory framework. The significance and effects of the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement are usually judged critically by the public, especially with regard to the situation of developing countries.

Keywords: GATT; intellectual property; TRIPS Agreement; WIPO conventions; World Trade Order (WTO)
