Chapter Summary

Art. 62 addresses the acquisition and maintenance of intellectual property rights and related procedures. The acquisition of an intellectual property right is usually subject to a grant and registration procedure. While compliance with the substantive conditions has to be guaranteed the procedure must provide for the granting or registration within a reasonable period of time. Art. 4 Paris Convention (PC) also applies to service marks. This extension of the scope of the PC reinforces the comprehensive protection of trademarks under Art. 15 Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement securing the acquisition and maintenance of service marks.
