Chapter Summary

The Universal Declaration of Human Rights (Article 18) and the International Covenant on Civil and Political Rights (Article 18) enounce the right to freedom of thought, conscience and religion at the universal level for 'everyone'. In addition, on the universal level the International Convention on the Elimination of All Forms of Racial Discrimination (Article 5) offers protection against racial discrimination in the enjoyment of this right, and the International Convention on the protection of the rights of all migrant workers and their families (Article 12) confirms this right for migrant workers and members of their families. Article 5(1)(b) of the UNESCO Convention against Discrimination in Education contains one that is a little more elaborate, in that it refers to procedures in domestic law and that it adds that no one should be compelled to receive religious instruction inconsistent with his or her own conviction.
