Chapter Summary

This chapter identifies the content of the right to education and the corresponding State obligations enshrined in Article 28 of the Convention on the Rights of the Child. Another possible classification of the CRC's education rights is to place them under three headings: the right TO education, IN education and THROUGH education. Given the holistic nature of the CRC, Article 28 should not only be read together with Article 29 but also with several other articles of the Convention. The preamble of the CRC recalls the basic principles of the United Nations and specific provisions of relevant human rights treaties and proclamations. Finally, the relevant legal doctrine, including the findings of the Special Rapporteur on the right to education, has been consulted in the identification of the scope of Article 28 of the CRC.
