Chapter Summary

There is no other international human rights treaty that explicitly deals with the matter of separation of children from their parents with an exception for the African Charter on the Rights and Welfare of the Child (African Charter). Article 19 of that Charter is to a significant degree, similar to Article 9 of the CRC. There are some provisions in other international human rights instruments which are more indirectly relevant to the separation of a child from her/his parents and the maintenance of contact in case of such a separation. Article 24 of the International Covenant on Civil and Political Rights (CCPR) deals with the right of the child to special measures of protection. Article 8 of the European Convention on Human Rights (ECHR) contains inter alia the right to respect for family life.
