Chapter Summary

Article 8 of the CRC is a unique international human rights provision. There is no other international human rights treaty that contains a provision similar to Article 8. The right to be registered immediately after birth can be seen as closely related to the rights of every person to her or his own identity. One can also refer to Article 16 of the CCPR concerning the right of everyone to recognition as a person before the law. Finally it should be noted that the European Court of Human Rights (ECHR), in its interpretation of Article 8 of the ECHR, in particular the right to respect for private life, has ruled that this right covers an individual's physical and social identity, such as gender identification, name, sexual orientation and sexual life and the right to personal development and personal autonomy.
