Chapter Summary

Many States Parties to the CRC made general reservations concerning provisions considered incompatible with Islamic law, referring in rather general terms to national legislation taking account of the interest of the child and the need to safeguard its physical and mental integrity, as provided for in provisions of the Penal Code, in particular those sections relating to breaches of public order, to public decency and to the incitement of minors to immorality and debauchery. The CRC Committee has emphasized that States undertake measures to promote the participation of children in social life, 'as well as the effective enjoyment of their fundamental freedoms, including the freedom of opinion, expression, and association'. The CRC Committee encouraged the State Party to take all appropriate measures, including legal means, to fully implement Article 13, and to introduce measures.
