Chapter Summary

From the inception of international human rights law, the right to an adequate standard of living has been included. While it has been a right proclaimed 'for everyone', the focus is implicitly on adult persons who are assumed to take care of their families. Article 23 of the International Covenant on Civil and Political Rights (CCPR), on the protection of the family, provides in Article 23(4) that in the case of dissolution, provision shall be made for the necessary protection of any children. Important for the interpretation of Article 27(2) is the provision of Article 18 that parents have common responsibility for the upbringing and development of the child, while Article 19 requires the State to protect the child against abuse and neglect while in the care of parents or other primary caregivers. This chapter discusses other related international human rights provisions similar to Article 27 of the CRC.
