Chapter Summary

The right to social security is guaranteed in a large number of universal and regional human rights treaties. This chapter introduces the relevant provisions in the Universal Declaration of Human Rights (UDHR), the Convention on the Elimination of All Forms of Racial Discrimination (CERD), the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), the International Covenant on Economic, Social and Cultural Rights (CESCR) and the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families (ICRMW). Attention is also paid to the ILO Social Security Convention No. 102, amongst others, which is explicitly or implicitly a point of reference for many of the social security provisions in human rights treaties. Article 26 of the CRC, if read in light of other human rights and ILO treaties, imposes more specific obligations on the State than Article 27 does.
