Chapter Summary

Article 34 of the Committee on the Rights of the Child (CRC) obliges States Parties to the CRC to take comprehensive measures against the sexual exploitation and sexual abuse of children. Sexual abuse is an inherent component of sexual exploitation in commercial situations, e.g. in relation to brothels exploiting children in the trade for sex and the use of the Internet to help generate and/or convey child pornography. The drafting process of Article 34 of the CRC and subsequent developments suggest that the main focus of the provision is the sexual exploitation of children. This entails, in particular, three situations: child prostitution, child pornography, and child trafficking for sexual purposes. The thrust of Article 34 of the CRC is to advocate a variety of interdisciplinary measures against child sexual exploitation and abuse, including laws, policies, effective implementation measures, personnel, mechanisms, resources and mindset-building through education, socialization and mobilization.
