Chapter Summary

The CRC drafting history clearly reveals the close link between the various treaties, especially as far as the CCPR is concerned. It examines aspects of this relationship, complemented by exemplary references to other treaties, nonbinding instruments and relevant mechanisms based on the UN Charter and the work of the UN Commission on Human Rights. Finally, international humanitarian law addresses deprivation of liberty in relation to the responsibilities of the parties to international or non-international armed conflict. The 1987 European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment strives to prevent ill-treatment in places of detention through a visiting mechanism. The Council of Europe, furthermore, has adopted several policy recommendations on relevant criminal justice issues, most recently 'on new ways of dealing with juvenile delinquency and the role of juvenile justice'.
