Chapter Summary

The Rome Convention can no longer work effectively in relation to the protection of the rights of broadcasting organisations. In light of this situation, a proposal to consider establishing a new convention was raised at WIPO and subsequently, discussions were commenced towards a new international instrument. The first occasion that the above proposal was raised, was the Committee of Experts on a Possible Protocol to the Berne Convention for the Protection of Literary and Artistic Works. This chapter examines the discussions held at the foregoing Committee of Experts on a Possible Protocol to the Berne Convention for the Protection of Literary and Artistic Works, the WIPO World Symposium on Broadcasting, New Communication Technology and Intellectual Property and the WIPO Standing Committee on Copyright and Related Rights. Through the examination, the issues to be resolved to conclude a new convention for the protection of the broadcasters' rights are clarified.
