Chapter Summary

Consulting the oracle of Delphi and applying the precautionary principle do not quite represent the same method of dealing with uncertain threats - although some of the principle's critics might have it otherwise. In the debate on the legal implications of the precautionary principle that is taking place at the international level as well as within many a nation state, various interpretations give rise to recurrent misunderstandings. The main research question of the present study, is this: What are the rights and/or duties of states under the precautionary principle in general international law. The answer to the research question will be sought after chiefly analyzing the practice of states with regard to the precautionary principle, in light of any expressions of opinio juris sive neccesiates accompanying it.
