Rule 5: Non-Compliance with the Rules

Chapter Summary

This chapter talks about the rule 5 of the Rules of Procedure and Evidence of the statute of the Special Court of Sierra Leone (SCSL). This rule discusses the non-compliance with the rules, as amended on 29 May 2004. The chapter then presents two cases and their trial chambers decisions. The first case is of Prosecutor v. Brima, Kamara, Kanu for the Decision on the Confidential Joint Defence Motion to Declare Null and Void Testimony-in-Chief of Witness TF1- 023, 25 May 2005. The second case is of Prosecutor v. Norman, Fofana, Kondewa for the Decision on Urgent Motion for Reconsideration of the Orders for Compliance with the Order Concerning the Preparation and Presentation of the Defence Case, 7 December 2005. Finally, the chapter talks about the appeals chamber decisions.
