Chapter Summary

Proceedings before the special chambers shall be governed by the Rules applicable in contentious cases before the Tribunal. According to article 15 of the Statute, the special chambers may hear and determine disputes only. Article 107 of the Rules provides that proceedings before the special chambers are governed by the Rules applicable in contentious cases before the Tribunal, subject, however, to the provisions of the Convention, the Statute and the Rules relating specifically to the special chambers. No provision exists either in the Statute or in the Rules for the special chambers to render advisory opinions. There has been no occasion so far for the Tribunal to pronounce itself on the question whether a chamber may render advisory opinions.
