Chapter Summary

Discussions over setting up a permanent jurisdictional body began early during talks held by the Working Group that was commissioned to design the system stipulated in Annex III of the 1991 Treaty of Asuncion. This group of experts reviewed precedents covered by bilateral and multilateral integration treaties, in addition to reviewing the mechanisms for resolving conflicts within the international community for disputes in general, including the system of the International Court of Justice. Setting up the Permanent Review Court may be viewed as significant, in terms of the mechanisms in effect through to late 2003, although it fails to satisfy those who have urged the implementation of a real jurisdictional entity since the adoption of the Treaty of Asuncion in 1991, since that would constitute a pillar supporting and ensuring compliance with the objectives of the integration process.
