Chapter Summary

This chapter presents a second dumping case brought before a Panel since 1995. As usual in dumping cases, the dispute concerned review of the conditions of application by national authorities of the provisions of the 1994 Anti-dumping Agreement, but it also entailed review of the consistency of national regulations with the provisions of the Anti-dumping Agreement. Korea lodged a complaint concerning United States review, after 1995, of previously decided anti-dumping measures on imports of certain computer components from Korea. The Panel Report clarified some elements of the transitional law applicable between the GATT 1947 and the GATT 1994. Beyond this aspect of limited temporal interest, it made findings of more long term interest concerning the conditions for implementing review of anti-dumping duties pursuant to Article 11.2 of the Anti-dumping Agreement. A mutually satisfactory agreement on implementation was finally obtained.
