Chapter Summary

The profound transformations that have characterized Russias transition to a market economy have clearly created a need for a new, independent and highly professional judicial system as the legal underpinnings of economic reform. The new arbitrazh systems primary goal is to assert the rule of law governing commercial relations and to enforce basic legal principles: independent judges, equality of all before the law and the court, adversarial proceedings and equal rights of the parties, transparency and directness of all judicial proceedings and decisions. The process of enacting the Civil Code has been accompanied by a gradual reform of the judicial system and the systematic improvement of procedural legislation regulating the activity of the arbitrazh courts. All the measures are designed to raise the effectiveness of the arbitrazh courts in implementing the provisions of the new Civil Code in the conditions of a modern Russian economy.
