Chapter Summary

The HPD/HPCC process was conferred with exclusive jurisdiction to register and resolve three categories of residential property claims arising out of property rights violations that occurred during the preceding decade. This chapter commences with an outline of the category and nature of claims which fell within the HPD/HPCC's exclusive jurisdiction. It considers the inquisitorial role conferred on the HPD at the claims intake and investigation stage, commencing with its responsibility to ensure a careful and comprehensive account of the facts in each case in the claim form. The procedures which regulated the notification and participation of parties and the publication of claims are also considered. Claims were termed in accordance with the provisions of UNMIK Regulation 1999/23 as category A, B and C claims.
