Chapter Summary

This chapter describes the pre-decisions making process, which involved the investigation and preparation of claims for referral to the HPCC for adjudication. This process was inquisitorial in nature given that oral evidence could not ordinarily be given before the HPCC and the decision making process was non-adversarial. Legal offices reviewed claims individually and carried out investigations, including verification of documents and interviews with parties and were authorized to conduct any other investigations, ex officio where necessary, in order to establish all relevant facts relating to the claim. The provisions of Chapter II of UNMIK Regulation 2000/60 regulating the investigation and processing of claims were supplemented by the HPCC through its instructions and jurisprudence which provided guidance to the HPD on how to organize and conduct the claims processing aspect of its mandate. These instructions and the HPCCs jurisprudence are considered throughout the chapter.
