Chapter Summary

Section 2.6 of United Nations Interim Administration Mission in Kosovo (UNMIK) Regulation 1999/23 prescribed that the rules of evidence and procedure of the Housing and Property Claims Commission (HPCC) should guarantee fair and impartial proceedings, including provisions providing for the reconsideration of decisions. This chapter considers the reconsideration procedure from the perspective of the processing and adjudication of requests and sets out the jurisprudence of the HPCC in dealing with reconsideration requests. A reconsideration request could be filed by a party to the proceedings, or any other interested party who alleged a legal interest in the claimed property and could show good cause as to why he or she did not participate in the first instance proceedings. The chapter presents an example to explain the processing of a reconsideration request, provides the statistics on the adjudication of reconsideration requests, and the instances in which reconsideration requests were dismissed and granted.
