Chapter Summary

This chapter is written for the purposes of providing access to the case law of the Housing and Property Claims Commission (HPCC) in a relatively concise format. It sets out the key decisions of the HPCC which deal with issues of interpretation of the provisions of UNMIK Regulations 1999/23 and 2000/60 in addition to the applicable domestic laws. The presentation of the key case law sheds light on the scope of the applicable law which has impacted on the domestic legal order in Kosovo and has played a significant role in addressing residential property disputes arising out of the conflict. The chapter commences with an outline of the HPCCs jurisprudence in relation to the procedural provisions which applied to the filing of claims pursuant to section 1.2 of UNMIK Regulation 1999/23. It then considers the jurisprudence of the HPCC in relation to the adjudication of claims at first instance.
