Chapter Summary

The European Community (EC) and its member states have shared competences in marine environmental matters. They have jointly acceded to the LOSC and the main marine environmental agreements and they jointly participate in the work of the bodies established by these Conventions. This chapter establishes how the existence of shared competence between the Community and its member states and the difficulty in clearly dividing the respective spheres of powers affect the implementation of their international obligations for the protection and preservation of the marine environment. In European seas, the environmental provisions of the LOSC have been primarily implemented by means of three comprehensive agreements (i.e., the OSPAR Convention, the 1992 Helsinki Convention, and the BARCON). The Community participates in the LOSC and related marine environmental agreements alongside its member states.
