Chapter Summary

This chapter discusses the latest case before the International Court of Justice in which the Netherlands was a party: the case bearing the official title 'Legality of Use of Force (Yugoslavia v. Netherlands)'. The Netherlands is one of the 64 states that have recognized the compulsory jurisdiction of the Court pursuant to Article 36, paragraph 2, of the Statute of the Court. The chapter summarizes relevant facts and events that resulted in the application by Yugoslavia instituting proceedings against the Netherlands. It discusses the request by Yugoslavia for the indication of provisional measures, the Dutch position in relation to this request, and the Court's order of 2 June 1999. The chapter concentrates on subsequent developments and proceedings before the Court in this case, which resulted in the Judgment of 15 December 2004 in which the Court found that it had no jurisdiction in this case.
