Chapter Summary

This chapter provides an overview of human rights of the accused and the way in which they are protected. It can be stated that the International Criminal Tribunal for Rwanda (ICTR), like the other former and currently existing international criminal tribunals, was primarily established to fulfill a peace-building function, to defend and uphold the human rights of the victims, to enhance the respect for fundamental global norms of criminal law, and to avoid non-prosecution of alleged war criminals. However, the protection of fundamental human rights of the accused is of equal importance, as it is the litmus test for the fairness of both the trial and the appellate proceedings. The jurisprudence of the ICTR in relation to the protection of these human rights contributes to the implementation and observance of these rights also on the domestic level.
