Chapter Summary

This chapter talks about states parties and the commission on the limits of the continental shelf. It then focuses on the rise of International Maritime Organization's (IMO's) liability and compensation regimes. The chapter considers whether the Indian Ocean Tuna Commission (IOTC) has international legal personality. The IOTC was established by an international treaty made under the auspices of article XIV of the Food and Agriculture Organisation (FAO) Constitution and is located within the FAO framework. The chapter reviews the kind of measures being taken by regional fisheries management organisations (RFOs) against non-members, and then analyses the legal issues such measures raise. Finally, it discusses some international law aspects of the use of vessel monitoring systems for preventing illegal unreported unregulated fishing and the regulation of navigation under international law.
