Chapter Summary

To monitor compliance with the convention against torture and other cruel, inhuman or degrading treatment or punishment (Convention) provisions, a committee against torture (CAT) was established. The Committee handles cases relevant to Article 20 and Article 22 of the Convention. Article 20 is a potentially forceful articlewhich no doubt explains the existence of Article 28 of the Convention, which, quite unusually for a human rights convention, specifically raises the possibility that States may make a reservation in respect of Article 20 at the time of ratification. This chapter discusses conditions for receiving complaints. When the Secretariat of the Committee receives a complaint it immediately informs the member of the Committee who is appointed as thematic rapporteur to Article 22 communications. If conditions have been met, the Committee starts examination of the complaint as such.
