Chapter Summary

This chapter presents a hypothetical case that deals with the death of Rémulo Estrada in the State of Ithaka. It first presents a few procedural questions, and then gives the facts concerning the seizure of the Cronos magazine resulting on a possible violation of the American Convention by the government. Then the facts concerning the defamation proceedings are dealt with, with the focus on whether the fine imposed on the Estrada brothers constituted a violation of the American Convention. After presenting the facts concerning the application of disciplinary measures by the Ithakian Press Association, the chapter addresses the question whether the State of Ithaka is internationally responsible for the death of Estrada.
