Chapter Summary

This chapter deals with a hypothetical case relating to the conviction of crimes committed by terrorists of Frente Patriotico Francisco de Miranda (FPFM) during the civil war in the State of Miranda. It provides a statement of facts, and an outline on the conviction of the crimes. Next, the procedural history in the Inter-American Commission on Human Rights since 1997 is detailed. The legal analysis of the law and procedure focuses on major issues such as: admissibility issues; the Article 5 of the American Convention relating to the right to humane treatment; the Article 4 relating to the right to life; the Article 27 relating to the suspension of certain obligations in times of emergencies; personal liberty and integrity of the convicted terrorists during the emergency; and effective judicial remedies under Article 25 for the alleged violations.
