Chapter Summary

This chapter provides an overview of the protection of religious liberty under Article 18 of the International Covenant on Civil and Political Rights (ICCPR). The approach of the Human Rights Committee (HRC) is also analysed to see whether it matches the theoretical model of the right of the child to religious freedom. The chapter considers Article 18 and its interpretation by the HRC, and then applies it to children. The HRC might recognise the child dimension of the cases, and at other times it might not. There are instances where the HRC might accept the claims of a child against the state, and might accept the claim of a child who has come of age (for example in relation to freedom of choice, protection against third parties, freedom of manifestation, or religious education classes) and this would be acceptable.
