Chapter Summary

The Inter-American Commission on Human Rights has played an important role in the development of the jurisprudence concerning children's rights before the Court. Both through its reporting system and the work of its Special Rapporteur on Children, the Commission has identified subjects of concern in the region with regard to the protection of children. There are a number of cases, which are currently pending before the Commission and may potentially reach the Court. Some of these cases are related to topics that have already been the subject of adjudication before the Court such as the conditions of detention of minors in Latin America. Adolescents in the Custody of the FEBEM v Brazil and Minors Detained in Adult Jails vs Honduras are such examples. This chapter discusses some of the upcoming contentious cases on children's rights in the system.
