Chapter Summary

During the war in Peru from the total of 5,845 individuals acknowledged by official State figures as having disappeared 15.5 percent were children. At least half of the children in that percentage were under the age of fifteen. During the proceedings before Inter-American Court of Human Rights, the representative of the State tried to demonstrate to the Court that Peru had lived through a time of war and that those children were suspected of allegiance to subversives. The Gómez Paquiyauri case was first case where the Peruvian State was made accountable under international law for violating the rights of children. It was the first legal, moral pronouncement of international community that told the Peruvians, "You don't do this to human beings, let alone to children". We have no other recourse than to make those responsible for atrocities accountable for their deeds and to reinforce a sense of right and wrong.
