Chapter Summary

From the protection of Street Children to the protection of children in times of war: the Inter-American Court of Human Rights has delivered in recent years, ground-breaking rulings directly concerned with the rights of the child, both in times of peace and in times of war. So far, there is no other international tribunal with jurisdiction to produce binding decisions with a specific focus on children's rights in the manner of the Inter-American Court. This is the introduction chapter of the book, which analyses this jurisprudence on children systematizing the principles therein held by the Court. It reviews the new cases concerning the Rights of the Child dealt with at the Inter-American Commission level, some of which may potentially reach the Court. As the jurisprudence of the Court expands with new issues for adjudication coming under its jurisdiction, the author identifies an important trend emerging in jurisprudence of the system.
