From Treaty Bargains to a Constitutional Proposal and Back

Chapter Summary

There is no doubt about the support of the constitutional project by the German Presidency, but the question was how to re-start the reform process. Equipped with a mandate by European Council and in collaboration with the following two Presidencies, the German government found a solution for crisis which was initiated by failed referenda in France and the Netherlands in spring 2005. This map seems to be a mixture of two described options: Option 1 makes concessions to the governments and electorates of the remaining countries which still had to ratify the modified text; Option 2 describes how the renegotiation of a more transparent and efficient treaty provides a solution for the crisis. This chapter studies the final stage of reform process - initiated after the much-lamented treaty revisions by the Amsterdam and Nice Intergovernmental Conferences, which originally intended to reform the institutional framework before the enlarging of the European Union (EU).
