Chapter Summary

This chapter presents a case between the Prosecutor versus Radoslav Brdanin pending before in Trial Chamber II for the decision on Motion to dismiss indictment. The accused (Radoslav Brdanin) was charged with a crime against humanity, based upon persecutions on political, racial or religious grounds. The fact remains that there is no basis in the Rules of Procedure and Evidence upon which the Trial Chamber could review the decision of the confirming judge that the material provided by the prosecution to that judge supports the material facts pleaded in the indictment. The Chamber decided that detention of the Accused is lawful, and he has no right to have the decision of the confirming judge reviewed. The Motion for Release was refused. This chapter is presented in English and French.
