Chapter Summary

This chapter looks at the role of special procedures in facilitating or providing remedies to victims. It also looks at the general principles of remedies based on a United Nations declaration of 2006 on the subject. The former Commission on Human Rights adopted, in 2005, a set of Basic Principles and Guidelines on the right to a remedy and reparation for victims of gross violations of international human rights law and serious violations of international humanitarian law. The document was subsequently endorsed by the ECOSOC and adopted by the United Nations General Assembly. The Working Group on Arbitrary Detention was established by the former Commission on Human Rights in its resolution 1991/42 and entrusted with investigating instances of alleged arbitrary deprivation of liberty, according to the standards set forth in the Universal Declaration of Human Rights and the relevant international instruments accepted by the States concerned.
