Chapter Summary

The scheme of the settlement of disputes arising under the Federal Investment Law varies according to the nature of the dispute and the parties thereto. The relevant provision for the settlement of disputes is Article 27 of the Federal Investment Law, and this chapter deals with it as follows: first, the chapter focuses on Iraqi law as the applicable law, and what disputes have been exclusively reserved for its application; next, the settlement of disputes under another applicable law chosen by the parties to the dispute, and the relevant competent courts. Then the chapter examines the choice of arbitration for the settlement of disputes. This covers arbitration under Iraqi law, as well as under international arbitration schemes. Lastly, recourse to the International Court of Justice (ICJ) for the settlement of disputes is treated.
