Chapter Summary

This chapter briefly explains the background of the Colombian conflict. It analyses the national legal instruments that have been developed to address the issues of individual criminal responsibility, the truth about serious crimes and the obligations of members of illegal armed groups to repair victims. The chapter considers the challenges in implementing the Law in practice and in the context of the on-going peace process and the strengthening of the judiciary, which has seen an increased focus on apprehending paramilitaries for their involvement in the drugs trade, having significant impact on victims' rights. The 2005 Law on Justice and Peace, with its subsequent amendments and implementing regulations has created a comprehensive legal framework with the aim of achieving peace with illegal armed groups, while at the same time providing a significant degree of accountability for those responsible for serious crimes.
