Chapter Summary

This chapter deals with developments towards the recognition of the right to an effective remedy as lay down in international instruments, with emphasis on the normative content of this right. Special attention will be given to the United Nations (UN) Basic Principles and Guidelines on the Right to a Remedy and Reparation for the Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law , adopted in their final form by the UN General Assembly in 2005 and marking a milestone in the lengthy process towards the framing of victim-orientated policies and practices. The International law commission Articles on State Responsibility were referred to as setting out legal consequences in terms of obligations of a State to stop wrongs attributable to that State and to repair the harm done to injured parties.
