Chapter Summary

Like any international tribunal, the European Court of Human Rights (ECHR or Court) has the devote part of its case law exploring its own jurisdiction since it is has it belongs the delimitation of the jurisdiction under section 32.2 of the European Convention on Human Rights (ECHR or Convention). The case of Markovic and others v Italy has raised the various legal problems; but in practice and the way in which the Court considers its jurisdiction follows Bankovic. The applicants recalled that they had asked the Court of Rome to rule on a civil action for compensation for the moral damage caused by a wrongful act, deemed to have been committed, at least in part, on Italian territory, under Article 6 of the Italian Penal Code. The doctrine of the act of government or political act is the reverse of immunity. The original text of the chapter is in German.
