Chapter Summary

Acting under Chapter VII of the Charter, the Security Council adopted 31 March 2005 Resolution 1593 by which it would defeat the Prosecutor of the International Criminal Court in Darfur. This decision is part of the struggle of this body since the end of the Cold War against the impunity of crimes, replacing the failing national justice in international criminal justice. Acting always under Chapter VII, the Council requested the Secretary General to establish an international commission of inquiry to investigate the reports of violations of international human rights law and international humanitarian law by all parties to the conflict to determine whether acts of genocide have occurred and to identify those responsible. Only two months after the submission of this report, the Security Council finally decided to act on the request of the Commission.
